Please read all of our terms and conditions before using HOMAYU.

General

We, at HOMAYU (OPC) PRIVATE LIMITED ("HOMAYU", "We", "Us") provide services to all individuals accessing or using our HOMAYU platform ("Platform") for any reason ("you", "yours", "User") subject to the notices, terms and conditions set forth in these Terms and Conditions ("Agreement"), together with our Privacy Policy.

The Platform is owned and operated by HOMAYU (OPC) PRIVATE LIMITED, a company duly incorporated under the provisions of the Companies Act, 2013. HOMAYU may assign, transfer, and subcontract its rights and/or obligations under these Terms and Conditions to any third party, as it may deem fit, and you shall continue to be bound by these Terms and Conditions in the event of such assignment, transfer or subcontracting.

Any accessing or browsing of the Platform and use of the Services (as defined below) indicates your agreement to all the terms and conditions in this Agreement. If you disagree with any part of the Terms and Conditions, you may discontinue access or use of the Platform.

Eligibility

When you use the Platform, you represent that you meet the following primary eligibility criteria:

  • You are at least 18 years old, or accessing the Platform under the supervision of a parent or guardian, who will be deemed the recipient/end-user of the Services for the purpose of these Terms and Conditions.
  • If you are below 18 years old, your parents or legal guardians can transact on your behalf if they are registered users. You are prohibited from purchasing any material whose sale or purchase to/by minors is prohibited and which is for consumption by adults only.
  • You are legally competent to contract, and otherwise competent to receive the Services. Persons "incompetent to contract" within the meaning of the Indian Contract Act, 1872, including un-discharged insolvents, are not eligible to use the Platform.
  • You have not been previously suspended or removed by HOMAYU, or disqualified for any other reason, from availing the Services.

HOMAYU reserves the right to terminate your membership and/or refuse to provide you with access to the Platform if HOMAYU discovers that you are under the age of 18 years.

Our Services

Through the Platform, we provide you with the following services ("Services"):

Creating and maintaining user accounts

To use our Services, Users need to register on the Platform and provide certain personal details including but not limited to name, phone number, email address, birth date and gender. When you create an account with us, you must provide information that is accurate, complete and current at all times — failure to do so may result in immediate termination of your account. You are responsible for safeguarding your password and for any activities under it, and must notify us immediately upon becoming aware of any breach of security or unauthorized use of your account. You may not use a username that infringes another's rights, or that is offensive, vulgar or obscene.

Scheduling an appointment for medical consultation

You can book an appointment for a medical consultation with a Homeopathic Doctor / Ayush Doctor / Alternative Medicine physician ("HSP — Health Service Provider") listed on the Platform. You will receive a confirmation of your appointment on the Platform and/or via SMS/email/online messaging. We reserve the right to reschedule or cancel an appointment without prior notice. Consultations can be booked or rescheduled free of cost up to fifteen minutes prior to the start of the appointment.

Holding medical consultations

You can have an Online Medical Consultation via audio call, video call or chat with the HSP selected by you. You are fully aware that you will not undergo a physical examination during the consultation, and that this does not preclude your right to visit a physician for a physical examination at any time. The opinion delivered by the HSP is based solely on the communication between the HSP and the patient, and any reports/information provided by you. Your medical records will remain accessible to you for a specific number of days after a consultation, as determined by the HSP. The Services are not meant for emergency or life-threatening conditions — please visit the nearest hospital in such cases.

Other Services offered include receiving an e-prescription based on the consultation, accessing your medical records on the Platform, and any other service made available on the Platform from time to time.

Your Use of the Platform

Due diligence

  • You are solely responsible for the medical, health and personal information you provide, and should use your discretion in providing it.
  • The advice or services provided by the HSP depend on the information you provide. You will provide accurate and complete information at all times.
  • You are solely responsible for all access to and use of this site under your password and identification, whether or not authorized by you, and for protecting its security and confidentiality.
  • Your information may be used by us for Services including analysis, research, training and disclosure (where required) to our affiliates, group companies, agents and government authorities, as stated in our Privacy Policy.
  • We reserve the right to refuse service or terminate accounts at our discretion if we believe you have violated or are likely to violate applicable law or these Terms and Conditions.

Scope of services

The Services availed by you from an HSP via the Platform are an arrangement between you and the HSP. The Platform only facilitates connections between you and the HSP, and bears no responsibility for the outcome of any consultation or Service obtained. HOMAYU shall not be liable for deficiency or shortfall in Services, misdiagnosis, faulty judgment, interpretation or perception error, adverse events, inefficacy of prescribed treatment or advice, or unavailability of recommended treatment or medication. Users are advised to use their discretion in following advice obtained from an HSP.

HOMAYU only facilitates connections through the Platform and does not encourage or require you to contact the HSP outside the Platform. If you are redirected to another website or app from the Platform, HOMAYU will not be responsible for products or services received or purchased there. You may view and access content on the Platform solely to avail the Services and shall not modify, reproduce, display or distribute such content for any commercial purpose.

Prohibited Content

You shall not upload, distribute or publish through the Platform any content that:

  • Belongs to another person and which you do not own the rights to.
  • Is harmful, harassing, blasphemous, defamatory, obscene, pornographic, invasive of another's privacy, insulting on the basis of gender, libellous, racially or ethnically objectionable, or otherwise contrary to law.
  • Is hateful or disparaging of any person, or relates to money laundering or gambling.
  • Could harm minors in any way, or infringes any patent, trademark, copyright or other proprietary right.
  • Violates any law in force in India, deceives or misleads recipients, or communicates information that is grossly offensive, patently false, or intended to mislead or harass.
  • Impersonates another person, contains software viruses or malicious programs, or threatens the unity, integrity, defence, security or sovereignty of India or friendly relations with other states.
  • Is abusive or inappropriate towards the HSP conducting your consultation, or any HOMAYU employee, consultant or technician, and is unrelated to the consultation or services availed.

If you fail to adhere to the above, we have the right to remove such information and/or immediately terminate your access to the Services and/or the Platform.

Indemnity

You agree to indemnify and keep indemnified HOMAYU, its affiliates and the concerned HSP for any losses, costs, charges and expenses (including reasonable attorney fees) suffered on account of deficiency or shortfall in Services arising from your failure to provide correct or complete clinical information, suppression of material facts, misinterpretation of advice/prescription, failure to follow the HSP's instructions, incorrect payment details, or permitting a third party to use your password or account.

Limitation of Liability

The Services availed by you from an HSP via the Platform are provided by that HSP, not by HOMAYU. The Platform only facilitates communication between you and the HSP; HOMAYU bears no responsibility for the quality or outcome of Services obtained. HOMAYU itself does not provide any medical consultation services — if you receive medical advice or investigation reports from an HSP, you are responsible for assessing that advice and for all post-consultation follow-up. Services provided through the Platform are not a substitute for a face-to-face consultation with a doctor.

To the extent permitted by applicable law, HOMAYU and its affiliates will not be liable for any special, indirect, incidental, consequential, punitive or exemplary damages arising out of or relating to these Terms and Conditions, your use or inability to use the Platform or its AI assistant, or your use of any third-party services including those provided by any HSP. This section shall survive termination of this Agreement.

Data & Information Policy

We respect your right to privacy in respect of any personal information provided to us for availing our Services. To see how we collect and use your personal information, please see our Privacy Policy.

Intellectual Property and Ownership

You recognize and agree that all copyright, registered trademarks and other intellectual property rights on all materials or content provided as part of the Platform belong to us at all times, or to those who grant us the license for their use. No use of these may be made without our prior written authorization.

Copyright policy: we respect the intellectual property rights of others and respond to any claim that content posted on the Service infringes a copyright or other intellectual property right. If you are a copyright owner (or authorized on behalf of one) and believe your copyrighted work has been infringed, submit your notice in writing to our copyright agent at homayu24@gmail.com with a detailed description of the alleged infringement. You may be held accountable for damages for misrepresenting that content is infringing.

DMCA notice: a valid DMCA notice under 17 U.S.C. 512(c)(3) should include a signature of the authorized person, a description of the copyrighted work and its location or a copy of it, identification of the allegedly infringing material's URL, your contact details, and good-faith and accuracy statements made under penalty of perjury. Upon receipt, the Company will take whatever action it deems appropriate, including removal of the challenged content.

Other Conditions

Your payments are processed in accordance with applicable law. We make every effort to display information provided by relevant third parties (including HSPs) as accurately as possible, but do not undertake liability in respect of such information, or any other information where you are capable of conducting your own due diligence.

Third-Party Links and Resources

Where the Platform contains links to other sites and resources provided by third parties, these links are provided for your information only. We have no control over the content of those websites/platforms or resources and accept no responsibility for them, or for any loss or damage arising from your use of them. HOMAYU is not a party to any contractual arrangement between you and a third-party website/platform, and such use implies full acceptance of these Terms and Conditions.

Amendments

We may from time to time update or revise these Terms and Conditions. Every time you wish to use the Platform, please check the relevant Terms and Conditions and Privacy Policy to ensure you understand the terms that apply at that time.

Events Beyond Our Control

We will not be liable for any non-compliance or delay in compliance with our obligations under any contract when caused by events beyond our reasonable control ("Force Majeure"), including:

  • Strike, lockout or other forms of protest.
  • Civil unrest, revolt, invasion, terrorist attack or threat, or war (declared or not).
  • Fire, explosion, storm, flood, earthquake, collapse, epidemic or other natural disaster.
  • Inability to use public or private transportation and telecommunication systems.
  • Acts, decrees, legislation, regulations or restrictions of any government or public authority, including judicial determinations.

Our obligations under any contract will be considered suspended during the Force Majeure period, and we will be given a corresponding extension to fulfil them.

Termination

We may terminate this arrangement at any time, with or without cause. You may terminate it at any time by discontinuing your access or use of the Platform. We reserve the right to refuse the use of Services immediately if your conduct is deemed to be in contravention of applicable laws or these Terms and Conditions, or considered unethical or immoral. For a change in law, we reserve the right to suspend our obligations indefinitely and/or provide Services under revised Terms and Conditions.

Applicable Legislation and Jurisdiction

The use of our Platform shall be governed by the laws applicable in India. Any dispute relating to the use of our Services shall be subject to the exclusive jurisdiction of the courts at Morbi, Gujarat, India.

Definitions

For the purposes of these Terms and Conditions:

  • Application means the software program provided by the Company, downloaded by you on any electronic device, named HOMAYU.
  • Application Store means the digital distribution service operated by Apple Inc. (App Store) or Google Inc. (Google Play Store) from which the Application was downloaded.
  • Affiliate means an entity that controls, is controlled by, or is under common control with a party.
  • Account means a unique account created for you to access our Service.
  • Country refers to Gujarat, India.
  • Company ("the Company", "We", "Us" or "Our") refers to HOMAYU (OPC) PRIVATE LIMITED.
  • Content refers to text, images or other information posted, uploaded, or made available by you.
  • Device means any device that can access the Service, such as a computer, cellphone or tablet.
  • Goods refer to the items offered for sale on the Service.
  • Orders mean a request by you to purchase Goods from us.
  • Service refers to the Application or the Website, or both.
  • Website refers to www.homayu.org.
  • You means the individual accessing or using the Service, or the entity on whose behalf such individual is doing so.
